What is a genuine redundancy?
A redundancy is deemed genuine if:
- The employee's job is no longer required to be performed by anyone; and
- The employer followed any and all consultation requirements
The requirements vary with each award but a general requirement exists for an employer to ensure the employee is fully informed on what is being considered, consultation occurs regarding the views and opinions of the employee involved and all avenues of redeployment within the organisation are explored.
